1. About us
These terms govern the services provided by Fair Play Web, run by James Mottram
and based in Snodland, Kent ("we", "our", "us"). By engaging us or using our tools you
agree to these terms.
2. Our services
We offer three distinct services, each with different terms:
- Web design ("Built Before You Pay") — we build a complete website and send you a preview. You only pay if you choose to go live.
- Custom builds — bespoke software, automation and AI work, scoped and quoted before any work begins.
- Subscription products — ready-made software such as Bosh, billed monthly.
3. Web design terms & the "no deposit, no risk" guarantee
- We build your website first and provide a preview link. No deposit or payment is required to receive the preview.
- You are under no obligation to proceed. If the site is not right for you, you simply do not pay and there is no invoice.
- If you choose to go live, the agreed one-off fee becomes payable in full before the site is published to your domain.
- The guarantee covers the initial build only. It does not cover later change requests, additional pages, third-party costs (e.g. domains, paid plugins, stock photography) or ongoing hosting.
- Once you have approved and paid for a site, that fee is for completed work and is non-refundable except as set out in our Refund & Cancellation Policy.
4. Custom build terms
- Custom work begins with a free scoping conversation followed by a written fixed quote.
- Unless agreed otherwise, 50% is payable on acceptance of the quote and the balance on delivery.
- The fixed quote is fixed. If you add requirements mid-project, we will agree a change order. If we underestimated, we absorb it.
- The deposit covers work already scheduled and carried out and is non-refundable once work has started.
5. Hosting & maintenance
- Optional hosting and maintenance is billed monthly in advance (currently from £25/month) and includes hosting, SSL, security and up to two small content updates per month.
- You can cancel at any time; cancellation takes effect at the end of the current billing month.
- If you cancel hosting, we will provide your site files for you to host elsewhere.
6. Subscription products (Bosh)
Subscription products are billed monthly with no minimum contract and can be cancelled at any time.
Specific product terms and any free-trial conditions are presented at sign-up.
7. Payment
Payments are processed securely by Stripe. Prices are in pounds sterling. We are not currently VAT registered;
if this changes, VAT will be shown separately. Late payment on agreed invoices may result in suspension of services.
8. Intellectual property
On full payment of the agreed fee, ownership of the final website design and content we create for you transfers to you.
We retain ownership of any underlying tools, code libraries and frameworks we reuse across projects, and the right to
feature the work in our portfolio. Third-party assets remain subject to their own licences.
9. Your responsibilities
You confirm that any content, logos or images you provide are yours to use, and that your business and its website
comply with applicable law. You are responsible for keeping your own account and domain credentials secure.
10. Liability
We provide our services with reasonable care and skill. To the extent permitted by law, our total liability arising
from any engagement is limited to the fees you have paid us for that engagement. We do not exclude liability for death
or personal injury caused by negligence, fraud, or anything else that cannot lawfully be excluded. Nothing in these
terms affects your statutory rights as a consumer.
11. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales.
